CHBA BC's Prompt Payment Pre-Submission Feedback

CHBA BC is extending the period for feedback from members on the potential of Prompt Payment legislation under consideration by the BC Attorney General.

To ensure our submission to the Province reflects the collective voice of our membership, including areas of concern and recommendations to mitigate impacts, we ask that members take time to consider and complete a brief survey to add to the concerns/comments expressed to date by members of our Government Relations Committee.

Your responses are crucial in shaping our position on this issue.

As part of our advocacy efforts on the potential introduction of Prompt Payment legislation, CHBA BC is recommending exemptions and delayed effective dates to provide stability for the residential construction sector. Prompt Payment legislation has been introduced into other provinces across Canada, including Ontario, Manitoba, Saskatchewan, Alberta and most recently, New Brunswick.

Over the years, there has been ample discussion about bringing this legislation to B.C., and CHBA BC has outlined our position opposing it in this document.

CHBA BC aims to provide our feedback before a consultation draft is completed by the BC government and shared with other stakeholders.

Please provide your feedback by Tuesday, June 24.

If you have any questions or need additional background information, please contact Taushifa@chbabc.org or Jenny@chbabc.org.

What is your business standard process for managing accounts payable, including approval timelines and payment cycles?

How long does it take your organization to pay contractors, subcontractors, and suppliers after receiving a complete and correct invoice?

What are the most common reasons for delays in processing payments (e.g., incomplete invoices, internal approvals, holdbacks, disputes)?

If legislation were to mandate a fixed payment timeline (e.g., 28 days), what changes would your business need to make to comply? What operational or financial challenges would this pose?

If a prompt payment framework included an adjudication process for payment disputes, how would that impact your accounts payable workflow and resource planning?

What considerations should be included in the design of prompt payment legislation to ensure it is workable for both builders and those managing accounts payable (e.g., flexibility for complex projects, clarity around documentation requirements, treatment of disputed amounts)?

If Prompt Payment rules are introduced, how much time should the industry be given to adjust?
